The Arkansas Department of Energy and Environment - Division of Environmental Quality (“DEQ”) and Merit Energy Company, LLC (“Merit”) entered into a May 15th Consent Administrative Order (”CAO”) addressing an alleged violation of an air permit. See LIS NO. 25-041.
The CAO provides that Merit owns and operates the Harmony Compressor Station in White County, Arkansas.
The facility is stated to operate pursuant to a General Air Permit for Minor Sources – Natural Gas Compressor Stations 1969-AGP-000 (“Permit”).
DEQ is stated to have performed a routine compliance inspection on April 10, 2024, covering the reporting period of October 2022 through February 2024. The inspection is stated to have determined that Engine BKE00384 was tested on May 15, 2023, at 9,910 hours. The Engine is stated to have previously been tested on February 15, 2022. The facility is stated to have failed to test the Engine within the 8,760 hours limit, violating Specific Condition 15 of the Permit and Subpart JJJJ of 40 C.F.R. § 60.
Merit neither admits nor denies the factual and legal allegations contained in the CAO.
A civil penalty of $1,200.00 is assessed.
