The Arkansas Department of Energy and Environment - Division of Environmental Quality (“DEQ”) and Acme Brick Company (“ABC”) entered into a Consent Administrative Order (“CAO”) addressing an alleged violation of an Air Permit. See LIS No. 25-045.
The CAO provides that ABC owns and operates a clay brick manufacturing facility in Malvern, Arkansas.
The CAO states that the facility operates pursuant to an Air Permit.
The CAO provides that on February 13, 2024, and March 7, 2024, the ABC facility conducted emissions testing for PM, VOC, COL, and HCL at the facility.
DEQ personnel are stated to have informed ABC on April 17, 2024, that a review of the stack test results had been completed and that the facility exceeded the emission limits at SN-14 and SN-18, as shown in Table 2 of the CAO, violating General Provision 27 of the Air Permit.
ABC is stated to have responded in May 13, 2024, correspondence that their Air Permit did not contain any Specific Conditions that required testing beyond the requirements of Subpart JJJJJ. It was further stated that the facility would troubleshoot and retest for CO by July of 2024 and submit a permit modification for the other emission exceedances. A permit modification to revise the CO, VOC, and HCL limits for SN-14 and SN-18 was submitted to DEQ on November 12, 2024, and deemed administratively complete on November 13, 2024.
ABC neither admits nor denies the factual or legal allegations contained in the CAO.
A civil penalty of $4,800.00 is assessed.
