The Mississippi Commission on Environmental Quality (“MCEQ”) and CF Rail Services, LLC (“CF”) entered into a March 4th Agreed Order (“AO”) addressing an alleged violation of an Air Permit. See Order No. 7458 25.
The AO states that CF was issued a Synthetic Minor Operating Permit for its rail services facility.
CF is stated to have been contacted by the Mississippi Department of Environmental Quality on January 6th and notified of the following violation:
- Respondent is operating without a valid permit in violation of Miss. Code Ann. § 49-17-29(1 )(b) which states, '"It is unlawful for any person to build, erect, alter, replace, use or operate any equipment which will cause the issuance of air contaminants unless that person holds a permit from the Permit Board." Condition 1.C.1 of Synthetic Minor Operating Permit No. 1460-00130 (the Permit) required Respondent to submit a renewal application to the Mississippi Environmental Quality Permit Board (the Permit Board) by no later than April 3, 2022. The Permit expired on September 30, 2022. Subsequently, Respondent submitted the renewal application to the Permit Board on January 3, 2023.
The AO assesses a civil penalty of $15,000.00. Further, CF is required to comply with all terms and conditions of Synthetic Minor Operating Permit No. 1460-00130 until the Permit Board acts on its renewal application.
