The Missouri Department of Natural Resources (“MDNR”) and AHF, L.L.C. d/b/a AHF of Pennsylvania, LLC (“AHF”) entered into a February 11th Administrative Order on Consent (“AOC”) addressing an alleged violation of the Missouri air regulations. No. APCP-2025-005.
The AOC provides that AHF operates an installation that processes and coats lumber to be used for hardwood floors and is located in West Plains, MO.
The facility is stated to utilize a Part 70 Operating Permit. However, the permit is stated to have expired on April 4, 2022.
AHF was required to submit a complete renewal application by October 4. 2021. While MDNR received the new application on October 4, 2021, it was missing a filing fee. The filing fee was stated have been received on October 7, 2021.
MDNR deemed the renewal application for the part 70 operating permit completed on October 7, 2021.
The AOC alleges that AHF failed to submit a complete operating permit renewal application at least 6 months prior to the expiration of its part 70 title 5 permit. Therefore, the AOC provides that AHF was operating without a valid operating permit.
The AOC requires that AHF cooperate with MDNR’s Air Pollution Control Program Permitting Section for the timely issuance of a new Operating Permit. Further, AHF can continue to operate under the Part 70 Operating Permit subject to all permit conditions and requirements until the new Operating Permit is issued.
