The Missouri Department of Natural Resources (“MDNR”) and the City of Malden d/b/a Malden Municipal Power and Light (“MMP&L”) entered into a January 15th Administrative Order on Consent (“AOC”) addressing an alleged violation of an Air Permit. See No. APCP-2025-001.
The AOC provides that the City of Malden owns and operates a power station located in Dunklin County, Missouri.
The MMP&L power station is stated to operate pursuant to a Part 70 Operating Permit. Such Permit is stated to have expired on January 19, 2023. It is alleged that MMP&L is required to submit a complete permit renewal application by July 29, 2022, and that MDNR did not receive the complete renewal application for the Part 70 Operating Permit until September 22, 2022.
As a result, the power station is stated to have been operating without a valid Permit since January 29, 2023.
The AOC assesses a civil penalty of $3,750.00. However, it further states that the Air Pollution Control Program:
…is fully suspending the penalty based on the Respondent’s assistance resolving wastewater violations by Dunklin County #1 and the Respondent’s full cooperation with the Department.
The AOC also requires that MMP&L continue to operate under the Part 70 Operating Permit until the new Operating Permit is issued.
