Air Enforcement: Tennessee Air Pollution Control Board Proposed Order Addressing Bradley County Ready Mix Concrete Facility

The Tennessee Air Pollution Control Board (“Board”) issued a January 22nd Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Smyrna Ready Mix Concrete, LLC (“Smyrna”) addressing an alleged violation of an Air Permit. See Case No. APC24-0231.

The Order describes Smyrna as operating a concrete batch plant with two silos and an Extec Pitbull crusher in Bradley County, Tennessee.

The facility is stated to have been issued an Operating Permit on May 5, 2022.

The Tennessee Division of Air Pollution Control (“Division”) is stated to have conducted an inspection on September 19, 2024, at the facility. A review of Smyrna’s production logs is stated to have determined that the production rate for calendar year 2023 was 71,920.5 cubic yards. This is alleged to be an exceedance of 1,920.5 cubic yards.

The facility is stated to have submitted a modification application on September 26, 2024, requesting an annual production limit increase in the Permit from 70,000 cubic yards to 200,000 cubic yards per year as a corrective action.

The Order proposes a civil penalty of $2,250.00.
