Air Enforcement: Tennessee Air Pollution Control Board Proposed Order Addressing Morristown Resin Pellet Manufacturing Facility

The Tennessee Air Pollution Control Board (“Board”) issued a July 31st Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Colortech, Inc. (“CI”) addressing an alleged violation of an Air Permit. See Case No. APC25-0085.

The Order provides that the CI facility was issued a Conditional Major Source operating permit on October 31, 2024.

CI is stated to operate a resin pellet manufacturing facility in Morristown, Tennessee. The facility is stated to produce white, black, and color pigment resin pellets for the plastics industry.

The Division of Air Pollution Control is stated to have received a construction permit application on December 11, 2024, to construct certain new sources. The application is stated to have included VOCs and hazardous air pollutants emissions from certain sources that were not included in the permit applications dated December 10, 2014, January 26, March 17, May 3, December 20, 2022, and October 17, 2024.

The Order alleges that omitting these pollutants from the applications resulted in emission limitations not being established for VOCs and HAPs in the Permit.

The Order assesses a civil penalty of $3,000.00.

CI is provided certain appeal rights.
