A. Contested Case:
AL2024-008, Southern Orthopaedic Surgery Center, LLC, Montgomery County, AL: Proposes to develop a freestanding, non-hospital-based, limited multi-specialty ambulatory surgery center (ASC) specializing in orthopedics and neurosurgery in the city of Montgomery, Montgomery County, Alabama. Upon completion, the proposed ASC will have six (6) operating rooms (two of which will be shelled out space only), two (2) procedure rooms, nine (9) pre-operative rooms, and fourteen (14) Phase I recovery stations. The applicant will invest in a robotic arm to assist with minimally invasive joint replacement surgery. Opposition: Jackson Hospital & Clinic, Inc. and Jackson Surgery Center, LLC; Baptist Medical Center South, and Montgomery Surgical Center, LLC. Opposition filed by parties listed 4/5/2024. Request for contested case filed 4/12/2024 and 4/15/2024. ALJ assigned 4/24/2024. ALJ’s order received 10/31/2024. Exceptions filed 11/7/2024. Carried over from the 11/20/2024 CONRB meeting.
Approved. However, the Certificate of Need Review Board stipulated that the services provided at the facility must be limited to orthopedic procedures only and that the facility must be 100% owned by Southern Orthopaedic Surgeons.
B. AL2024-024, Magnolia Neuro Rehab, LLC, Madison County, AL: Proposes to add physical therapy and speech language pathology to its existing facility, which currently provides occupational therapy services. Opposition: None. Approved.
