  • The United States District Court for the District of New Jersey denied Apple, Inc.’s motion to dismiss a civil antitrust lawsuit filed by a bipartisan coalition of 16 AGs and the DOJ.
  • The complaint alleges that Apple illegally maintains a monopoly over smartphones by selectively imposing contractual restrictions on, and withholding critical access points from, developers. It also alleges that Apple undermines apps, products, and services that would otherwise make users less reliant on the iPhone, and lower costs, among other allegations.
  • In its opinion, the court found that the government alleged sufficient facts to support claims that Apple engaged in monopolization and attempted monopolization of the smartphone and performance smartphone markets, among other things.
