New Jersey’s wage transparency law that was signed by Governor Phil Murphy on November 18, 2024, will take effect on June 1, 2025. For a more fulsome discussion of the ins and outs of New Jersey’s pay transparency law, check out our prior blog here. As the effective date approaches, employers should be aware of their obligations under the new law, including the requirements that they:
(1) disclose the wage or salary, general description of benefits, and other compensation programs for each new job or transfer opportunity in internal or external postings; and
(2) make reasonable efforts to announce, post, or otherwise inform all current employees about promotional opportunities in their departments before making promotion decisions.
Employers should prepare to comply with the law by:
- Determining and documenting the hourly and salary ranges for each position.
- Training HR, recruiting, and hiring staff on this new law, including its posting and disclosure requirements.
- Reviewing all external and internal job postings and advertisements carefully to confirm the requisite compensation information is included.
Also keep in mind that this law applies to private and public employers, as well as government entities, non-profits, and job placement, referral, and employment agencies.
