Bipartisan AG Coalition Urges the FCC to Close Robocall Loophole

  • A bipartisan coalition of 47 AGs submitted reply comments in support of the FCC’s proposed rule Improving the Effectiveness of the Robocall Mitigation Database, which would implement additional safeguards designed to increase accountability and accuracy among Robocall Mitigation Database (“RMD”) filings and prevent bad actors from accessing the U.S. telephone network.
  • In the comments, the AGs note that the RMD is an essential resource in their efforts to combat illegal robocalls but that the information submitted by providers often includes false, incomplete, or misleading contact information, blank or inapplicable mitigation plans, and conflicting representations compared to other FCC filings or public data.
  • The AGs support the FCC’s proposed measures to improve the accuracy of RMD entries. These measures include providing clear guidance to define previously undefined terms, requiring providers to update their information within 10 business days of any changes, mandating the use of multi-factor authentication and a PIN for each submission, implementing a filing fee, employing technical data validation checks on submissions, and imposing strict penalties on providers who submit false or inaccurate information.
  • We have previously reported on other bipartisan AG efforts to combat illegal robocalls, including the Anti-Robocall Multistate Litigation Task Force’s issuance of warning letters to iDentidad Advertising Development LLC, All Access Telecom, Inc., Lingo Telecom, LLC, and several others for their alleged roles in facilitating robocalls.
