Plaintiff, Ronald Carpenter, filed suit against various defendants, claiming his lung cancer was caused by exposure to asbestos from their products. Carpenter alleged various exposures, including as a child when his father worked with asbestos-containing automobile parts at his gas station and as an adult when he was employed as a truck driver. At trial, only negligence, design defect-consumer expectations, design defect-risk benefit, and negligence-failure to warn claims remained against BWDAC Inc., PACCAR Inc. and Pneumo Abex, LLC.
The jury returned a defense verdict, finding Carpenter’s asbestos exposure was not a substantial factor in his lung cancer.
