CBP Announces Filing Procedures For Granted Section 301 Exclusions

On February 10, 2019, Customs and Border Protection (CBP) added the ability in Automated Commercial Environment (ACE) for importers to file entries with exclusions from Section 301 duties.

U.S. importers who have been granted Section 301 exclusions from USTR should report their regular HTS number, as well as the subheading 9905.88.05 for the exclusion. Although the first batch of product exclusions were announced on December 28 (see our previous post here), the government shutdown prevented CBP from updating ACE to include this ability.

The exclusions are available for any company that imports the specific products. They are retroactive to July 6, 2018 and will remain in effect until December 2019.
