On November 29, the CFPB announced in the Federal Register a final rule amending Regulation V (12 C.F.R. Part 1022), which implements the FCRA. The rule sets maximum allowable charge for consumer file disclosures at $15.50 for 2025. This amount remains unchanged from 2024 and is based on the FCRA’s annual adjustment formula, which ties the cap to changes in the Consumer Price Index for All Urban Consumers.

The FCRA requires consumer reporting agencies to provide consumers with one free file disclosure every 12 months and under specific circumstances. When a consumer is not entitled to a free disclosure, the agency may impose a reasonable charge, originally capped by the FCRA at $8.00. This cap increases annually based on the Consumer Price Index, with the CFPB using the $8.00 baseline from 1997 to determine the 2025 charge. The rule will go into effect January 1, 2025.
