On February 12, the U.S. SDNY granted the CFPB’s request to extend its deadline to explain if the Bureau wishes to continue its litigation efforts. The Bureau filed a letter with the SDNY requesting a two-week extension. The additional time will give the CFPB two weeks to inform the court whether the Bureau intends to continue prosecuting an action involving allegations that a fintech violated the Military Lending Act.
As previously covered by InfoBytes, and in response to the defendant’s request for leave to file a stay motion, the court previously ordered the CFPB to file a letter by February 14 stating whether it intends to continue prosecuting the action. The CFPB was granted a fortnight extension from February 14, which was made with the defendant’s consent; the CFPB now has until February 28 to file that letter. The CFPB’s letter explained an extension is necessary to allow CFPB leadership to assess enforcement priorities but will keep all other case deadlines in place. The court’s docket stated it granted the CFPB’s request, notifying the CFPB could file its status letter on or before February 28.
