On March 19, the union representing CFPB employees filed its notice of amended proposed preliminary injunction order in its suit against the CFPB Acting Director Russell Vought. As previously covered by InfoBytes, the union had filed suit alleging Vought’s actions aimed to dismantle the Bureau exceeded its executive authority and usurped the legislative authority conferred upon Congress.
Following a March 11 evidentiary hearing, the union amended their proposal to address key concerns raised during the hearing, including removing references to the CFPB’s statutory functions and focusing on enjoining the enforcement of a stop-work order issued on February 10. The amended order also seeks to prevent the wholesale cancellation of contracts, allowing for individualized assessments instead. Additionally, the proposed order maintained a prohibition on mass terminations of CFPB employees, a measure which had been agreed upon at the start of the case. The CFPB opposed the entry of a preliminary injunction and has declined to file a joint proposed order.
