CFPB will continue prosecution of lender, alleging violations of Military Lending Act and UDAAP

On February 28, the CFPB submitted a letter to the U.S. SDNY advising it will continue to pursue a lawsuit from 2022 alleging a lender violated the Military Lending Act and UDAAP provisions of the CFPA. As previously covered by InfoBytes, the lender previously submitted a letter to the court requesting leave to file a motion to stay the litigation, citing a directive issued by the Acting Director of the CFPB advising that the Bureau would seek to pause all ongoing proceedings. The court denied this request and ordered the CFPB to inform the court by February 14 whether it would continue to prosecute. After the court agreed to extend the deadline to February 28, the Bureau informed the court that the Acting Director has authorized the continued prosecution of the lawsuit.

This decision was made on the same day the Bureau decided to voluntarily dismiss, with prejudice, other pending lawsuits and enforcement actions (covered here and here).
