Citizen Suit Action/Clean Water Act: Los Angeles Waterkeeper Files Judicial Action Addressing California Railroad Maintenance/Service Facilities

Los Angeles Waterkeeper (“Waterkeeper”) filed a November 18th Complaint for Declaratory and Injunctive Relief and Civil Penalties (“Compliant”) against Union Pacific Railroad Company (“Union Pacific”) in the United States District Court (Central District of California).

The Complaint was filed pursuant to the federal Clean Water Act as a citizen suit action alleging violations of the Clean Water Act.

The Complaint addresses the following Union Pacific facilities:

  • City of Industry, California facility, whose primary industrial purpose is described as a rail line maintenance and fueling yard, and transportation corridor.
  • Long Beach, California facility, whose primary industrial purpose is described as locomotive repair and fueling.
  • Long Beach, California facility, whose primary industrial purpose is described as conducting railroad repair, maintenance, and fueling.
  • Santa Fe Springs, California, whose primary industrial purpose is described as locomotive fueling and intermodal freight transfers.

Waterkeeper states that a Clean Water Act citizen suit Notice Letter was previously sent to Union Pacific alleging ongoing violations of substantive and procedural requirements of the following:

  • Clean Water Act.
  • California’s General Industrial Storm Water Permit.
  • Water Quality Order No. 2014-0057-DWQ.

The Complaint alleges that discharges from the referenced facilities have violated the monitoring, reporting, and best management practices of the relevant Storm Water Permits and the Clean Water Act.
