The Connecticut Department of Energy & Environmental Protection (DEEP) released a Request for Information late Friday seeking “expressions of interest from potential project developers who believe that they can (1) meet the end of 2027 in service date to qualify for production or investment tax credits authorized by sections 45Y and 48E of the Internal Revenue Code, or (2) meet the July 4, 2026, start of construction requirement to continue to make use of the production or investment tax credits authorized by sections 45Y and 48E of the Internal Revenue Code.”
DEEP is exploring whether to issue an expedited request for proposals to procure new, advanced stage solar and wind generation resources at risk of losing eligibility for certain federal tax credits under sections 45Y and 48E of the U.S. Internal Revenue Code. Developers have an opportunity to inform this expedited procurement by submitting a response to DEEP’s Request for Information.
DEEP requests responses on or before 4:00 PM on August 1, 2025. Responses using the DEEP template should be emailed to DEEP.EnergyBureau@ct.gov with “Response to Expedited Procurement RFI” in the subject line.
Users should read the Request for Information thoroughly before responding. There are two important things to note when crafting a response to the Request for Information. First, DEEP recognizes that there is still uncertainty regarding the final outcome of any Treasury regulations related to these projects but has opted to get the Request for Information out as quickly as possible. Therefore, if any developers require certain caveats in order to successfully develop their projects, they should make those caveats known to DEEP. Second, to the extent that developers wish to submit confidential information to DEEP as part of their response to the Request for Information, developers should carefully follow the directions for doing so that DEEP has provided.
