Privacy litigation has taken California (and the country) by storm. In the past twenty-four months, the focus of privacy litigation has shifted from data breaches to data use, and the number of class actions filed grows by the minute. But what is this new wave of data use litigation? The claims are riddled with terms hardly ever used in ordinary conversation, such as pixels, web beacons, javascript, first-party cookies, third-party cookies, GET requests, public vs. private IP addresses, and many more. Moreover, why are these claims being asserted under a statute (California’s Invasion of Privacy Act (CIPA)) that was enacted decades ago while the California Consumer Privacy Act (CCPA) took effect recently and is actually intended to regulate this conduct?
