The United States Environmental Protection Agency (“EPA”) and Owens-Brockway Glass Container Inc. (“OB”) entered into an April 8th Consent Agreement (“CA”) addressing alleged violations of the Resource Conservation and Recovery Act (“RCRA”) hazardous waste regulations. See Docket No. RCRA-09-2025-0030.
OB is stated to operate a glass container manufacturing facility in Tracy, California.
The facility is stated to hold an EPA RCRA ID number.
The manufacturing processes are stated to generate various waste streams that are considered RCRA hazardous wastes including but not limited to dust produced by the electrostatic precipitator which carries the following RCRA waste codes:
Also referenced are the furnace batch ash and furnace brick and debris generated by the furnaces which carry RCRA hazardous waste codes:
- D010.
- D004.
- D006.
- D007.
- D008.
Waste sodium hydroxide solution from parts washing is noted, which carries the RCRA waste code D002.
EPA is stated to have conducted a Compliance Evaluation Inspection (“CEI”) of the facility on January 30, 2024. The following violations were allegedly identified:
- Failure to make an accurate waste determination.
- Operating without a permit due to failure to maintain and operate the facility to minimize the possibility of any unplanned release.
- Operating without a permit due to failure to maintain a complete contingency plan.
- Operating without a permit due to failure to maintain personnel training records.
A civil penalty of $47,836.00 is assessed.
