The Health Insurance Portability and Accountability Act of 1996, as amended by the Health Information Technology for Economic and Clinical Health Act, and the regulations promulgated thereunder (collectively “HIPAA”) is a federal privacy law which regulates use and disclosure of protected health information (“PHI”). PHI generally includes: (i) individually identifiable health information that is (ii) created or received by a provider or plan that (iii) relates to health care or payment for health care, which is (iv) maintained or transmitted in any form.
