Important Update for Massachusetts Employers: February 1, 2025 Wage Data Reporting Deadline

Earlier this year, Massachusetts enacted a new law entitled an Act Relative to Salary Range Transparency (the “Act”). Under the Act, employers must disclose certain salary and wage information in job postings and advertisements, and provide wage information to employees and job applicants under certain circumstances. These disclosure requirements are slated to take effect on October 29, 2025.

Additionally, the Act requires employers with 100 or more Massachusetts-based employees to submit a wage data report to the Secretary of the Commonwealth by February 1, 2025, and by February 1st annually moving forward.  

Earlier this week, the Secretary of State created a portal for employer wage data report submissions, and also published additional guidance on the Act (Workforce Data Reporting FAQs).  Employers must submit their wage information (the EEO-1 Wage and Workforce Data Reports) to the portal using one of the following formats: PDF, JPEG, or PNG.

Employers should remain cognizant of the upcoming deadlines under the Act, and consult with counsel to ensure compliance.
