House Bill 566-FN (“566”) has been introduced into the 2025 New Hampshire legislative Session addressing landfill leachate.
566 would require permit applications for new landfills in the state to contain a detailed plan of leachate management.
The Bill would prohibit approval of permits for new landfills, including expansions, unless applicants submit a leachate plan meeting to specified requirements. Such requirements include:
- Narrative of how leachate will be collected and stored on site.
- Narrative of how leachate will be transported off-site, and location and type of disposal processing.
- Details of any and all contractual arrangements between the applicant and any and all entities that will be engaged in the transport and the processing of leachate (including demonstration that the contractual arrangements are enforceable under the law.)
- Contractual arrangements are required to demonstrate for the entirety of the operating life of the landfill including the post-closure period, that the expected daily production of leachate can and will be transported off-site in a manner that will minimize the possibility of on-site contamination.
- A statement of the projected frequency of leachate transports per month.
- Demonstration that there will be sufficient capacity to process the leachate, including any contingency plans for capacity constraints.
