Massachusetts Cannabis Control Commission Accepting Public Comments for On-site Social Consumption Establishments

On December 13, 2024, the Massachusetts Cannabis Control Commission (“Commission”) voted to receive public comments to proposed Social Consumption Establishment Regulations until January 23, 2025, at 5:00 p.m.

Summaries of the proposed Supplemental License, Hospitality License, and Event Organizer License for Qualifying Entities can be found on the Commission’s website.

The Supplemental License would be available to existing qualifying Marijuana Establishments, including Cultivators, Product Manufacturers, Retailers, Microbusinesses, Craft Marijuana Cooperatives, or Delivery Operators, e.g., a Marijuana Establishment with an On-site Consumption Space attached – such as a Lounge, Café, Tasting Room, etc.

The Hospitality License for Qualifying Consumption Licensee is intended for a new or existing non-cannabis commercial business space, e.g., a Lounge, Café, Entertainment/Recreational Space, Yoga Studio, Theater, Lodging Space.

The Event Organizer License would be available to Qualifying Entities that intend to organize and host Temporary Consumption Events. Only Marijuana Establishments would be able to participate in a Temporary Consumption Event pursuant to a Temporary On-site Consumption Permit allowed at single or multiple locations. The Qualifying Entity would be allowed to store/purchase cannabis at a Principal Place of Business (PPB), provided that the entity is party to a Host Community Agreement with the local municipality at the PPB, local permitting and approval has been obtained for Temporary Consumption Events, and that such events be no more than five days in length and the entity hold no more than 24 events per year.

Commissioners will take up the draft regulations for further discussion and vote in early 2025. Prior to the opening of a formal public comment period, stakeholders are encouraged to submit any initial feedback for the proposed policies as currently written to Commission@CCCMass.com with the subject line, “Social Consumption” no later than 5 pm on Thursday, January 23, 2025.
