Massachusetts’ Stay-at-Home Order: What Businesses Need to Know

The Order requires many businesses to close, but allows essential industries to continue operating, and permits employees to work remotely, as applicable.

On March 23, 2020, Massachusetts Governor Charles D. Baker issued the Order Assuring Continued Operation of Essential Services in the Commonwealth, Closing Certain Workplaces, and Prohibiting Gatherings of More Than 10 People (COVID-19 Order No. 13) (the Order), pursuant to which (1) certain COVID-19 Essential Workforces are urged to continue operations during the state of emergency and do so with allowance for social distancing protocols, (2) all businesses and other organizations that do not provide COVID-19 Essential Services in Massachusetts shall close their physical workplaces and facilities to workers, customers and the public, but are encouraged to continue operations where they are able to operate through remote means, and (3) gatherings of more than 10 people are prohibited throughout Massachusetts except for operations of any business in the provision of COVID-19 Essential Services. Violations of the terms of the Order may result in a criminal fine in a criminal penalty pursuant to Section 8 of Chapter 639 of the Acts of 1950 or a civil fine of up to $300 per violation. The Order is effective beginning March 24, 2020, at 12:00 p.m. ET, through April 7, 2020.
