New California Whistleblower Notice Requirements for Employers

While California whistleblowers have long received protection under California law, effective January 1, 2025, California employers have new notice requirements. California employers must ensure their posting is up-to-date with the new model notice which is available here: Whistleblowers are Protected.

Employers who use the recently issued model notice will be compliant with the whistleblower posting requirements under California law. The posting must be printed to 8.5 x 14-inch paper with margins no larger than one-half inch in order to conform to the statutory requirement that the lettering be larger than size 14-point type. While employers can still choose to use their own posting, such notice must be displayed in 14-point font and include the whistleblower hotline number: 1-800-952-5225.

While the law does not specifically provide guidance how to issue the notice to remote workers, Labor Code section 1207 provides that employers may email employees with notices included as attachments. Email notice does not alleviate an employer’s obligation to also physically display the notice.
