NJ AG Secures Landmark $2+ Billion Settlement with DuPont Over PFAS Contamination

  • New Jersey AG Matthew Platkin and the state’s Department of Environmental Protection announced a settlement valued at over $2 billion with E.I DuPont de Nemours and Co. (now known as EIDP) and various DuPont-related entities, resolving multiple lawsuits regarding alleged contamination from per- and polyfluoroalkyl substances (PFAS) and other pollutants at four industrial sites across New Jersey.
  • Under the terms of the settlement, the companies will pay $875 million in damages over 25 years to compensate New Jersey for natural resource damages, to fund abatement projects, and to cover other costs, fees, penalties, and punitive damages. The companies will also create remediation funds of up to $1.2 billion to ensure cleanup of the affected site and establish a $475 million reserve to protect taxpayers should one of the companies declare bankruptcy or otherwise fail to fulfill their obligations.
  • As we have previously reported, DuPont has settled similar claims with Ohio and Delaware.
