Pending Virginia Site Plans, Special Permits and Special Exceptions to Expire July 1, 2025

For the first time since 2009, the Virginia General Assembly has not extended the validity periods for all approved site plans, special permits and special exceptions. Under Code of Virginia Section 15.2-2209.1:1, all valid site plans, special exceptions, special use permits and conditional use permits had expiration dates and deadlines within those approvals were extended until July 1, 2025, or longer if agreed to by a locality. 

Because the General Assembly did not extend the validity period, valid approvals under Section 15.2-2209.1:1 will expire on July 1, 2025, unless they have a later expiration date. Many jurisdictions allow owners to request extensions of site plans, special exceptions, special use permits and conditional use permits, but may have different rules for when those extension requests must be submitted. If an extension of any approval or condition within an approval is necessary, owners should check with their land use attorney or the jurisdiction to ensure they file requested extensions in time.
