PFAS/South Carolina General Assembly: Bill Prohibiting Discharge into Waterway/Drinking Water Supply Filed

H. 3116 was introduced on January 14th into the South Carolina General Assembly addressing perfluoroalkyl and polyfluoroalkyl substances (collectively, “PFAS”).

The Bill would require that the South Carolina Department of Environmental Services promulgate within 180 days of the effective date of its enactment regulations prohibiting the discharge of any contaminant level of PFAS in any waterway or drinking water supply of the State.

Chapter 6, Title 48 of the South Carolina Code would be amended.

The South Carolina Department of Environmental Services is provided the authority to enforce the provisions of the legislation with Section 48-6-70 and any other provision of law. Further, it is provided the ability to coordinate with the South Carolina Department of Health, Department of Agriculture, and Department of Commerce in enforcing the legislation.

H. 3116 was referred to the Committee on Agriculture, Natural Resources and Environmental Affairs.
