The Mississippi Commission on Environmental Quality (“MCEQ”) and East Side Jersey Dairy Inc. (“ESJD”) entered into an April 30th Agreed Order (“AO”) addressing alleged violations of a Clean Water Act Pretreatment Permit (“Permit”). See Order No. 7489 25.
The AO provides that ESJD owns and operates a dairy processing facility in Attala County, Mississippi.
The facility is stated to discharge wastewater to the City of Kosciusko’s sanitary sewer system. Therefore, it is subject to a Pretreatment Permit.
ESJD was contacted by the Mississippi Department of Environmental Quality and notified of the following violations of the Permit:
- Violation of effluent Carbonaceous Biochemical Oxygen Demand discharge limitations during the April, May, June, July, August, September, October, November, and December monitoring periods in 2023, during the January, February, March, May, and June monitoring periods in 2024, and during the January 2025 monitoring period.
- Violation of effluent Total Suspended Solids discharge limitations during the April, June, July, August, September, October, and November monitoring periods in 2023, during the January, February, August, September, October, and December monitoring periods in 2024, and during the January 2025 monitoring period.
ESJD is stated to have submitted Discharge Monitoring Reports on March 28, 2025 and April 23, 2025 demonstrating compliance with the discharge limitations required by the Permit during the February and March 2025 monitoring periods.
The AO assesses a civil penalty of $25,000.00.
