The Mississippi Commission on Environmental Quality and Natureplex entered into a May 3rd Agreed Order (“AO”) addressing alleged violations of the Clean Water Act Pretreatment Permit. See Order No. 7323 24.
The AO addresses a pharmaceutical manufacturing facility in Olive Branch, Mississippi.
Natureplex is stated to have been contacted by the Mississippi Department of Environmental Quality (“MDEQ”) and notified of the following alleged violations:
- Failure to submit discharge monitoring reports by no later than the 28th day of the month following the completed reporting period.
- Discharge of wastewater without an active permit following the expiration of its Pretreatment Permit.
- Failure to take samples at the nearest accessible point after final pretreatment but prior to actual discharge into the POTW collection system or mixing with non-regulated waste streams.
- Failure to submit an application for reissuance at least 180 days prior to permit’s expiration.
- Failure to collect samples that were representative of the volume in nature of the monitored wastewater.
- Failure to sample Isopropyl Acetate, n-Amyl Acetate, Acetone, and Ethyl Acetate during a referenced monitoring period.
- Failure to document the time of sampling or the location where sampling occurred.
A civil penalty of $15,750 is assessed.
