Judge Nathan approved the parties’ proposal to maintain the case on administrative hold pending completion of proceedings in the Braintree v. Novel matter in New Jersey district court, to which the Federal Circuit recently remanded that case for claim construction of the term “clinically significant electrolyte shifts” and for additional factual findings to determine whether the composition covered by Novel’s ANDA product infringes under the new claim construction.
