Recent PTAB Decision Involving Wildseed Mobile and Google Includes Rare Dissent

The Patent Trial and Appeal Board (PTAB) recently made a notable pair of decisions invalidating patents held by Wildseed Mobile LLC as obvious over art asserted by Google. Wildseed Mobile, a mobile technology company, previously asserted the patents at issue against Google, targeting the way ads work on YouTube.

The case is notable because dissents in PTAB decisions are uncommon, occurring in only about 1% of cases. In this particular instance, one administrative patent judge dissented in part from the majority decision, showcasing the contentious nature of the case.

The PTAB’s decision was not unanimous, reflecting the contentious nature of the case. Despite the division, the majority ruling found that Wildseed Mobile’s patents did not meet the required standards of novelty and non-obviousness. Consequently, the board invalidated the disputed patents, effectively siding with Google.
