Section 311/Clean Water Act Enforcement: U.S. Environmental Protection Agency and Laconia, New Hampshire Car Care Center Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and Meineke Car Care Center, Inc. (“Meineke”) entered into a January 30th Expedited Settlement Agreement (“Agreement”) addressing an alleged violation of Section 311 of the Clean Water Act.

The Agreement provides that Meineke is the owner or operator of a facility in Laconia, New Hampshire.

Oil as defined in 40 CFR §110.1 is stated to have been discharged from a waste oil tank onto the floor of a vehicle maintenance service garage. The spilled oil is stated to have flowed via pipe into a small stream that flows to Lake Winnipesaukee. The discharge of oil is alleged to have been in such quantities as may be harmful as defined in 40 CFR §110.3 and therefor in violation of Section 311(b)(3) of the Clean Water Act.

Meineke neither admits nor denies the specific allegations in the first paragraph of the Agreement.

The Agreement assesses a civil penalty of $2,500.00.
