The Mississippi Commission on Environmental Quality (“MCEQ”) and Cullum Construction, LLC (“CC”) entered into a June 25th Agreed Order (“AO”) addressing alleged violations of a Clean Water Act Stormwater Permit. See Order No. 7514 25.
The AO provides that CC owns and operates a sand and clay mine in Meridian, Mississippi.
The mine was stated to have been granted coverage under Mississippi’s Mining Storm Water, Dewatering, and No Discharge General Permit (“Permit”).
CC is stated to have been notified on June 2, 2023, of the following violations that were discovered during a Compliance Evaluation Inspection at the mine on April 4, 2023:
- Failure to implement the Storm Water Pollution Prevention Plan (“SWPPP”).
- Failure to submit a major modification form.
- Failure to identify mine boundaries.
- Failure to meet non-numeric limitations.
- Failure to maintain a buffer zone.
- Forming an unauthorized dump.
- Placing waste in wasters of the state.
The Mississippi Department of Environmental Quality is stated to have conducted a site investigation on May 28, 2024, and determined that the violation of Act 9 Condition L-2(1) of the Permit and the violation of Miss. Code Ann. § 49-17-29 had been corrected. Further, CC is stated to have submitted color photographs on November 13, 2024, and asserted that it was in compliance with the Permit and applicable state law and regulations.
A civil penalty of $8,500.00 is assessed.
