U.S. SDNY retains restrictions on DOGE’s access to Treasury payment systems

Recently, the U.S. SDNY left in place a temporary restraining order that was imposed on DOGE from accessing Treasury payment systems. As previously covered by InfoBytes, the U.S. SDNY blocked DOGE temporarily from accessing payment systems, payment records and other data systems operated by the Treasury’s Bureau of Fiscal Services. In response, Iowa and 18 states’ attorneys general filed a motion to submit an amicus brief in support of the defendants.

The nineteen states’ attorneys general challenged DOGE’s powers, alleging that DOGE’s access to Treasury payment systems put vast amounts of state-appropriated funding at risk and posed a cybersecurity threat. The court’s decision maintained the current restrictions on DOGE’s ability to access Treasury records and systems as the court will now consider the motion for preliminary injunction.
