The Alabama Department of Environmental Management (“ADEM”) and Omega Waste Management, Inc. (“Omega”) entered into a November 27th Consent Order (“CO”) addressing alleged violations of the Alabama Used Oil Regulations. See Consent Order No. 24-XXX-CHW.
The CO provides that Omega operates a waste transportation company with an EPA identification number and is headquartered in Patterson, Louisiana.
Omega’s activities are stated to include operating as a used oil transporter as defined in ADEM Admin. Code Div. 14.
ADEM issued a Used Oil Transport Permit Number to Omega on March 23, 2018. The Permit is stated to have expired on March 22nd.
ADEM is stated to have received Omega’s application for renewal on May 14th. The renewal application is stated to have been accompanied by written notification that Omega had transported four shipments of used oil in the State of Alabama after the expiration.
As a result, the CO provides the following alleged violations:
- Transportation of used oil in the State of Alabama without an effective Used Oil Transport Permit.
- Beginning hazardous waste or used oil transportation activities prior to the granting of the appropriate permit by ADEM, except as directed by the agency during emergency response.
Omega neither admits nor denies ADEM’s contentions.
A civil penalty of $4,000.00 is assessed.
