The Southern Environmental Law Center (“SELC”) on behalf of the Tennessee Wildlife Federation entered into multiple Settlement Agreements (“Agreements”) with the Tennessee Department of Environment and Conservation (“TDEC”) addressing water withdrawals on the Duck River.
The Agreements limit the amount of water that multiple utilities can withdraw from the Duck River.
The three agreements include:

SELC in a February 4th news release states that the Agreements were entered into after 8 local water utilities applied to increase the amount of water withdrawn from the Duck River.
SELC states that the proposal would have increased daily water consumption by 22 million gallons. Concern was expressed by the organization that the increase in water withdrawals would threaten the health of the Duck River.
The Agreements are stated to include more stringent permit terms addressing:
- Water conservation
- Drought management
- Water-loss prevention
