Section 6 of the Toxic Substances Control Act (TSCA) requires an assessment of unreasonable risk to “potentially exposed or susceptible subpopulations” (PESS) in high-priority substance risk evaluations. Wiley is partnering with Stantec to explain how the U.S. Environmental Protection Agency’s (EPA's) May 2024 Final Rule provisions concerning vulnerable communities may impact information requirements for companies or industry associations participating in the next 20 risk evaluations under TSCA.
In the Final Rule, the EPA states that risk evaluations will include considerations for “overburdened communities” identified by the Agency based upon reasonably available information. These considerations may include geographic proximity, workers living in communities near facilities, the number of industrial emitters in a community, life stage or pre-existing health conditions, and non-chemical stressors.
This webinar will identify what’s at stake for manufacturers, processors, and users of chemicals under review. The session will close with the collective views and recommendations from these experienced practitioners on what companies can do to prepare for the work ahead.
