In July, the full U.S. Court of Appeals for the Fifth Circuit found the FCC’s Universal Service Fund (USF) to violate the Constitution in several ways. This decision reversed an earlier decision by a panel of the court upholding the program and contradicts decisions by the 6th and 11th Circuits on appeals brought by substantially the same parties. The decision casts doubt on the future of a $9 Billion per year subsidy program that has enjoyed widespread Congressional support for nearly 30 years.
